Is Heath Ledger really dead?

Think about it, what if Heath Ledger isnt really dead. Joker may not die in Dark Knight and end up coming back in part 3. If they do great, hes not dead, but then it would be taking it to far with the lies. Like the thing they did with Blai witch project and say the kids really did die.
